Welcome to our website. These Terms of Use govern your access to and use of the online store operated by DOKKA PAWTRAIT®. By visiting or purchasing from this site, you agree to these Terms of Use and our Privacy Policy. Nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (ACL). If you do not agree, please do not use our services
Eligibility: You must be at least 18 years old or have valid parental or guardian consent to use this site and place orders.
Account and access: You are responsible for keeping your account credentials confidential and for all activities under your account. Provide accurate, complete, and current information and keep it up to date.
Orders and customisation: We produce personalised embroidered apparel from customer-submitted images and text. You confirm you own or have permission to use submitted content, we produce according to your inputs and approvals, and once production begins orders cannot be changed, cancelled, or refunded except as required by law or under our Return Policy. Minor variations may occur due to manual processes, including reasonable tolerances for colour, placement, and sizing (±1–2 cm).
Artwork proofs and timing: Where a proof or preview is provided, you must review and approve within the stated timeframe. Lack of response may delay your order. Timelines are indicative and may extend for revisions, public holidays, peak periods, or fraud checks.
Pricing, taxes, and payment: Prices are in AUD. GST applies where required and is shown at checkout. We may update prices, promotions, and availability at any time. Payments are processed securely through enabled gateways such as Shopify Payments, Shop Pay, Apple Pay, Google Pay, PayPal, or Stripe. We do not store full card details on our servers.
Shipping and delivery: Shipping methods, rates, and estimated timeframes are set out on our Shipping & Tracking page. Delivery dates are estimates and not guarantees. You are responsible for complete and accurate delivery details. Additional fees may apply for re-delivery or address corrections. Risk of loss passes on delivery to the address provided and title passes on full payment.
Returns and remedies: Your rights under the ACL apply. Our Return Policy explains assessment steps, eligible remedies, and timelines. For minor failures we may offer repair, replacement, or store credit. For major failures you may choose a refund or replacement. Follow the Return Policy for process and evidence requirements.
User content licence: By uploading photos, text, or other content, you grant DOKKA PAWTRAIT® a limited, non-exclusive, royalty-free licence to use, modify, and reproduce that content solely to design, produce, deliver, and support your order, including quality assurance, record-keeping, and fraud prevention.
Promotional display of finished works: Unless you opt out in writing, you allow us to display photos of finished embroidered products for promotional purposes without personal customer details. To opt out, email dokkapawtrait@gmail.com with your order number.
Warranties and indemnity for user content: You represent and warrant that your submitted content is lawful, does not infringe third-party rights, and that you have authority to grant the licence above. You agree to indemnify and hold DOKKA PAWTRAIT® harmless against claims, losses, or expenses arising from content you submit or instructions you provide.
Right to decline or cancel: We may refuse, edit, or cancel an order that includes content that is unlawful, infringing, hateful, or otherwise inappropriate, or where fraud risk is identified. If an order is cancelled before production, payments will be reversed in line with our Return Policy and applicable law.
Intellectual property: All site content and materials, including logos, designs, text, graphics, photos, product images, embroidery renderings, and software, are owned or licensed by DOKKA PAWTRAIT® and protected by Australian and international intellectual property laws. You may not copy, distribute, modify, reverse engineer, or create derivative works without written permission.
Acceptable use: Use the site only for lawful purposes. Do not interfere with the site’s operation, security, or performance. Do not upload malware, automated scripts, or harmful or illegal content.
Third-party services and links: This store is hosted on Shopify. We may link to or integrate third-party services. We are not responsible for the content, policies, or practices of third parties. Review their terms and policies where applicable.
Disclaimers: To the extent permitted by law, the site and its content are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. Nothing in these terms limits your non-excludable rights under the ACL.
Limitation of liability: To the extent permitted by law, we exclude liability for indirect, incidental, special, or consequential loss. Where liability cannot be excluded, it is limited to the replacement of the goods, the supply of equivalent goods, or the cost of doing so, as permitted by law.
Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including platform outages, network failures, strikes, natural events, or governmental actions. We will take reasonable steps to resume services.
Changes to the site and terms: We may update the site, products, and these Terms of Use from time to time. The latest version is posted on this page. Continued use after changes constitutes acceptance of the updated terms.
Governing law: These terms are governed by the laws of Australia and, where relevant, the laws of the State of Victoria. You submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
